WORLD NEWS: U.S. Court OK's Driving After Smoking Marijuana SAN FRANCISCO, California -- A U.S. appeals court in San Francisco has ruled motorists in Idaho can drive while they're high as long as their driving isn't erratic and they can pass a sobriety test. The court ruled Matthew Patzer, 21, could not automatically be presumed impaired because he was driving smoothly and passed two field sobriety examinations. The ruling overturned an impaired driving conviction against Patzer, who was stopped for having a broken tail light in 1998 and admitted to police he'd smoked marijuana at a party. Assistant U.S. Attorney for Idaho, Michael J. Fica, said the government may ask the court to review its decision or request the U.S. Supreme Court to hear the case. The decision was made by a three-judge panel at the San Francisco-based 9th U.S. Circuit Court of Appeals. In its ruling, the court wrote: "Given the distinction drawn by the statute, there is no basis to conclude that impairment may be presumed upon admission of use of a non-narcotic drug." While it's illegal to drive under the influence of alcohol or narcotics, Idaho law doesn't list marijuana as a narcotic. Idaho Senate Judiciary Chairman Denton Darrington said he had assumed marijuana was a narcotic under state law, and the statute might need to be reviewed.
