But jurors didn't get to decide the case against the bar owner, Walter Macon. Common Pleas Judge Carolyn Friedland dismissed the charge in midtrial Thursday. Friedland ruled that the prosecution didn't prove Macon was responsible for promoting and presenting the nude dance even though it took place in his bar June 23. Before the judge's decision, a witness, Barbara McFarland, moved to music and told jurors how she danced naked as patrons of the Emery Green Lounge in the Cleveland suburb Warrensville Heights thrust money at her. Jurors stood and craned their necks to watch the performance. Macon's lawyer, Almeta Johnson, told jurors her client didn't stage the act. He rented the bar to a group of men. The bar's liquor license doesn't permit nude dancing or allow clubs to rent the building and serve alcohol. Two witnesses said Macon closed the bar and brought dancers in on a Sunday to perform for eight men. Warrensville Heights police raided the bar in the middle of McFarland's act. McFarland said she had stripped off her cat suit, leopard-print teddy and thong when police arrived. Police found $817, either on the floor, in McFarland's possession or in the patrons' pockets. Macon wasn't there during the raid. "We respect the judge's decision but we disagree," Assistant County Prosecutor Brendan Sheehan said.
