Jack World News: New threat to transsexual marriage The Government is considering a further appeal after the full bench of the Family Court of Australia upheld a transsexual marriage. A spokeswoman for federal Attorney-General Daryl Williams said: "The government believes the case raises serious issues concerning the meaning of marriage under the Marriage Act and particular the role of the Parliament in determining the meaning of marriage. "In light of the importance of these issues, the Government is considering seeking special leave to appeal." The full bench of the Family court today upheld an earlier Family Court ruling on the validity of the marriage between a Sydney couple known only as "Kevin and Jennifer J". Kevin was born a female and had a sex-change operation. Before his marriage to Jennifer in August 1999, he had hormone treatment and irreversible surgery. He has a New South Wales birth certificate stating he is a male, a passport saying he is a male and the couple have had two children through in-vitro fertilisation. In October 1999, the couple applied to the Family Court to validate their marriage, and the court later declared the marriage valid. But Attorney-General Daryl Williams challenged that decision on the grounds Kevin was not a man. Today, the full bench of the family court - Chief Justice Alastair Nicholson, Justice John Ellis and Justice Sally Brown dismissed the challenge. No order was made as to costs.
